Terms of Service

Overview

These Terms govern your use of the Fossil website and hosted Fossil Cloud service, including trial credits, Solo, and Team offerings, hosted browser scans, results, workspaces, billing, and support. By creating an account or using Fossil, you agree to these Terms. If you act for an organization, you confirm you may accept them for it.

The service

Fossil uses a managed browser and model-assisted workflow to inspect eligible web applications and create product evidence such as screens, states, flows, and scan history. Results can be incomplete or inaccurate and must be reviewed before you rely on them.

An eligible verified account receives 10 one-time trial credits without requiring a payment card. They use the same usage-based reservation and settlement rules as plan credits, do not renew, and do not guarantee admission if safety, abuse, eligibility, credit, or capacity checks fail. Solo supports ongoing individual work; Team adds shared workspace and access-control features. Current plan details are shown in Fossil before purchase.

Accounts and workspaces

  • You must provide accurate account information and protect your authentication methods.
  • Workspace owners control membership, roles, project access, and billing.
  • You are responsible for activity by users you invite and for removing access that is no longer appropriate.
  • WorkOS provides authentication and organization identity.
  • Deleting a member account does not delete Customer Content owned by a shared workspace. A shared workspace owner must transfer ownership before deleting their account; a sole owner may explicitly delete their personal workspace and its content.

Targets and authorization

You may submit only targets you are authorized to inspect. Trial-credit targets must be eligible and reachable by Fossil's hosted browser. You must not use Fossil to bypass authentication, network controls, robots or rate limits, contractual restrictions, or other technical and legal boundaries.

Credentials, MFA, CAPTCHAs, payments, legal agreements, destructive actions, and sensitive personal-data entry remain human-only boundaries. Fossil may pause, limit, reject, or terminate a scan when safe execution cannot be established.

Subscriptions and payment

  • Current Solo and Team pricing, included usage, and billing cadence are shown before confirmation.
  • Polar handles checkout, payment, tax, invoices, subscription management, and the customer portal.
  • Subscriptions renew until canceled and remain subject to payment and applicable usage limits.
  • Cancellation normally takes effect at the end of the current billing period unless the checkout says otherwise.
  • Failed payment or exhausted included usage may pause new scans or other paid functionality.

Customer Content

You retain ownership of the URLs, instructions, screenshots, target content, comments, and other material you submit or generate through Fossil. You grant Fossil a limited right to host, copy, transmit, transform, and process that content only as needed to provide, secure, maintain, and support the service.

You confirm that you have the rights and authorization required for Customer Content. Fossil does not use Customer Content to train generative AI models. Retention and processor details are described in thePrivacy Policy.

Acceptable use

You must not:

  • scan or access systems, accounts, content, or data without authorization;
  • evade trial-credit uniqueness, usage limits, billing, safety checks, or access controls;
  • use Fossil for credential theft, surveillance, scraping prohibited by law or contract, or destructive actions;
  • upload illegal content or content that violates privacy, confidentiality, or third-party rights;
  • interfere with Fossil or its providers, probe infrastructure, or overload targets or the service;
  • resell or provide access to Fossil except where a written agreement permits it.

Third-party services

Fossil relies on services including WorkOS for authentication, Browser Use for hosted browsers, OpenAI for model processing, Polar for billing, Render for infrastructure, Cloudflare R2 for private scan-evidence storage in an EU-jurisdiction bucket, PostHog for analytics, and Resend for transactional security email. Their own terms and privacy commitments apply to their processing. Fossil may change a provider after appropriate security, privacy, and contractual review.

Support and changes

Support is available at hello@fossil.design. We may update, add, limit, or remove features as the service evolves and may suspend new scans for security, provider, or capacity reasons. We do not promise compatibility with every target, browser behavior, framework, or workflow.

Refunds and consumer rights

Refund and cancellation rights depend on applicable law and the terms shown during Polar checkout. We honor all non-waivable consumer rights. Contact support for a billing dispute or refund request.

Disclaimers

Fossil is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not guarantee uninterrupted operation, complete target coverage, error-free results, or suitability for a particular decision. Nothing here excludes a statutory right that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, Fossil is not liable for indirect, incidental, special, consequential, or punitive damages or loss of profits, revenue, data, goodwill, or opportunity. Our aggregate liability relating to Fossil is limited to the amount paid for the service during the twelve months before the claim.

Suspension and termination

You may stop using Fossil at any time. We may suspend or terminate access for breach, unlawful or unsafe use, fraud, abuse, security risk, failed payment, or material harm to Fossil, a provider, a target, or another person. Customer Content is handled under the retention rules in the Privacy Policy.

Changes to these Terms

We may update these Terms prospectively as Fossil changes. We will identify material changes through an updated date and provide additional notice where required.

Governing law

These Terms are governed by French law, except where mandatory law in your country requires otherwise. Courts with jurisdiction under applicable law may hear disputes.
